NEW SETTLEMENT
Kevin Costello recently obtained a significant six figure jury verdict award for the estate of a 78-year old woman who received third degree burns on her thigh while in the care of a nursing home.  After a four day trial, the jury awarded our client $180,000 for our client's pain and suffering, disfigurement, and loss of normal life arising from an incident in which she was burned from hot coffee she spilled on herself while a resident of a nursing home.  The jury found the nursing home negligent by placing our client, who suffered from dementia and tremors, in the main dining room rather than the assisted dining room at the time of the incident, and serving her a cup of hot coffee without a protective lid.  Our client suffered second and third degree burns on her legs from the spilled coffee and subsequently developed MRSA, a life threatening staff infection, as a complication of the burns.  She passed away two years later from unrelated causes.  All attempts to settle with the nursing home, including an offer just prior to trial to settle for significantly less than the subsequent jury award, were rebuffed by the nursing home, which refused to make any settlement offer whatsoever.
