David J. Loughnane
David J. Loughnane focuses his law practice on major state and federal civil litigation and trial work, particularly in areas related to healthcare, personal injury and privacy. During his legal career, Loughnane has tried more than 60 cases to a jury verdict. He has been engaged in many more trials, including bench trials.
In the healthcare field, Loughnane has tried cases with malpractice, personal injury and negligence claims involving hospitals, pharmaceutical companies and nursing homes.
His trials also have involved various licensed professionals, including doctors, dentists, hospital nurses, pharmacists, podiatrists, physical therapists, home delivery nurses and palliative care nurses.
Loughnane served for several years as regional Midwest counsel in neurologically impaired infant litigation for St. Paul Insurance, formerly the largest writer of professional medical liability coverage in the United States.
He is well versed in the medical care workplace issues such as hospital-staff relations, credentialing, fair hearings and privacy. Loughnane has counseled hospitals and individuals on the requirements of the Health Insurance Portability and Accountability Act (HIPPA) and the Health Information Technology for Economic and Clinical Health (HITECH) Act. He often advises groups that routinely deal with protected health information issues.
His extensive experience also reaches to litigated cases involving:
- product liability
- burn injuries
- severe automobile and truck accidents
- machinery injuries resulting in lost limbs, digits and vision
- commercial and residential liability, including structural failures and explosions
- municipal liability and alleged police misconduct
- traumatic brain injury and infant brain damage
- attorney malpractice
Loughnane is experienced in both mediation and arbitration primarily in the fields of professional liability, healthcare, private and commercial vehicle accidents, and slip and fall injuries. He holds mediation certificates from the Strauss Institute for Dispute Resolution at Pepperdine University School of Law and from Northwestern University.

For several years Loughnane has been named by his Illinois peers as a Leading Lawyer in the fields of medical malpractice and products liability. He also is an Illinois Super Lawyer and consistently receives Martindale-Hubbell’s highest rating, AV® Preeminent™.
PRIOR EMPLOYMENT
Loughnane has practiced at several well-known Illinois and Wisconsin law firms. Among his recent roles was serving for more than a decade as chair of the healthcare law group at a respected Chicago litigation firm. During law school, Loughnane worked for the Illinois Legislative Investigating Commission, an arm of the Illinois Legislature.
PRO BONO
A hockey enthusiast, Loughnane serves as counsel to the Amateur Hockey Association of Illinois (AHAI), which governs amateur hockey in the state. He also is counsel to USA Hockey, the national body that governs nonprofessional hockey in the United States.

PUBLICATIONS AND PRESENTATIONS
As a speaker, Loughnane has addressed evidence-related topics for the Illinois Institute for Continuing Legal Education. He has talked at hospitals on such topics as professional liability, HIPPA, staff relations, credentialing, membership, and obstetrical malpractice. Loughnane also has offered presentations to healthcare law interest groups on the topic of so-called “never events,” the incidents that should not occur in hospitals, nursing homes and healthcare facilities.
