Regan concentrates her
practice in commercial litigation and corporate law, with an emphasis in the
areas of construction and insurance. Regan has successfully represented
public and private sector clients in complex litigation involving
distributorships, guarantees, insurance, land use, construction, employment,
property damage, breach of fiduciary duty, fraud, and bad faith. She
advises her business clients on organizational and general corporate
matters, and regularly drafts and negotiates documents for commercial
transactions, including real estate, manufacturing, construction,
consulting, lending, and product licensing and distribution.
Regan has an extensive
construction practice representing owners, general contractors,
subcontractors and suppliers on public and private projects. She regularly
drafts and negotiates bidding and contract documents for a wide array of
project delivery systems for private sector, as well as state and local
government projects. Regan frequently litigates construction matters
involving competitive bidding, minority contracting, delay damages,
defective construction and/or designs, liens, liquidated damages,
indemnification, personal injury, termination, performance and payment bond
claims and surety takeovers. Regan focuses on getting the project completed,
and emphasizes practical solutions over litigation.
Since 1990, Regan has
regularly represented clients in connection with insurance issues. Her
representation has included insurance coverage litigation and arbitration,
insurance program analysis for compliance with state and local contracting
requirements, analysis and drafting of contract insurance specifications,
manuscript endorsements and reservation of rights, tender, demand and bad
faith letters. Regan has also advised national and state banks on
depository agreements, third party brokerage and insurance agency
arrangements and compliance issues. She has drafted and negotiated
construction loan documentation, and correspondent lending and underwriting
agreements, and has represented banking clients in litigation involving
construction loan priority and fictitious payees.
Regan has given
presentations on construction contracting for owners, contractors and
subcontractors, and on officers and directors liability insurance. She has
authored an article on additional insured coverage, “Are You Insured When
the Circus Comes to Town?”, and has co-authored, with partners David
McArdle and Kelly Cahill, the book “Construction Law Road Map 2007”
recently published in connection with the Illinois Road Builders
Association.
